AI Film Production Compliance
At Abduct Studios, our commitment to transparency, legality, and innovation forms the foundation of everything we do. By integrating Artificial Intelligence (AI) into our creative processes, we adhere to best compliance practices, respecting copyright laws, legislation, and ethical principles that guide the advertising market. Below, we explain our approach and how we ensure full compliance at every stage of production.
At Abduct Studios, AI is utilized as a tool within a broader creative process, not as the sole contributor to the final product. This approach strengthens our ability to claim copyright over the final product (in this case, a film), as there is significant human intervention at all stages.
AI as a Tool in a Comprehensive Creative Process
Artificial intelligence is employed as one of several elements in the creative workflow, similar to other technological tools like editing software, compositing, or 3D modeling.
The stages preceding and following the use of AI (such as scriptwriting, directing, editing, visual effects, and animation) are conducted by professionals, which characterizes predominant human authorship over the final product.
This differentiates the work from a piece generated exclusively by AI, as the result is a collaboration between technological use and human creative intervention.
Copyright in the Final Product
The film, as a complete audiovisual work, can be registered with full copyright protection, given that there is human authorship in all main stages, including:
Scriptwriting and Artistic Direction: Define the narrative and aesthetics of the film.
Editing and Post-Production: Include creative and technical decisions to integrate visual and sound elements.
Curation and Adjustments in AI: The use of AI to generate scenes, animations, or images is part of a creative process supervised and refined by individuals.
Audio and Soundtrack: Audio, including sound effects and soundtracks, is an essential part of the audiovisual work and receives the same legal protection, being considered a fundamental creative element.
In this case, AI does not replace human authorship but acts as an extension or facilitator of the creative work.
Process Documentation
To reinforce copyright protection, it is recommended to:
Record Creative Contributions:
Document human decisions at each stage of the creative process (such as scriptwriting, directing, adjustments in AI-generated scenes, and editing - Provided by Abduct Studios).
Maintain a detailed history of interventions made in images or videos generated by AI, highlighting human creative choices.
Register the Final Product:
Register the film as a whole with copyright authorities, attributing authorship to the creators and involved team.
Clear Credit for AI as a Tool:
In the film's credits, acknowledge the use of AI as a technology or tool (optional), clarifying that the film was created under human supervision and authorship.
Image Generation Models
Licensed Under Apache 2.0
We use image generation models licensed under Apache 2.0, which provides us with the security and transparency necessary to commercially explore the results ethically and reliably. In accordance with the terms of the license, we attribute due credit to the model creators, recognizing their essential technological contribution.
Regarding the copyrights of the generated images, we ensure originality through detailed documentation of human interventions performed in the creative process, including parameter adjustments, selection and curation of results, refinement and treatment of images, as well as the final composition, which may integrate various sources, whether generated by AI or not. We strictly follow best practices to guarantee that the generated content does not reproduce works protected by third parties, nor replicate specific illustration styles of artists, whether digital or in any other technique. For added protection, the generated works can be registered with competent authorities, providing the entire creation history, reinforcing our commitment to ethics and legality in the creation and use of images.
Important Rules:
We do not reproduce illustration styles of any specific artist without authorization, respecting the copyrights and intellectual property of each creator.
We do not use images of real people, whether current or historical celebrities, without prior authorization from them or the legal holders of their image rights.
We do not recreate scenes from existing works. We may use them as references, following the same principles adopted in the traditional advertising creation process, always ensuring originality and respect for copyrights.
AI technology has advanced at an impressive pace, rapidly transforming the way we create and produce content, especially in the cinematic universe. Undoubtedly, AI will become an increasingly relevant element in film production, enabling creative innovations and expanding narrative possibilities.
Although legislation on AI use is still in its early stages and generally slow to be defined, it is essential to respect the fundamental principles of copyrights, as well as to closely observe the terms of service and licensing conditions of the models used. This is undoubtedly the safest and most ethical path to integrate AI into the creative process, ensuring legal compliance and avoiding legal complications.
By adopting these practices, we can not only explore the full potential of technology responsibly but also value and protect the creative work of professionals involved in each stage of production.
